Welcome to deckguides.com (the “Site”). These Terms of Service (“Terms”) are a binding legal agreement between you and Deck Guides LLC, a Colorado limited liability company, governing your access to and use of the Site and any strategy guides, content, and services we make available (collectively, the “Service”).

By creating an account, purchasing a guide, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who we are and what we offer

Deck Guides provides written strategy content for the trading card game Magic: The Gathering, including free guides and paid “Full Access” guide content covering matchup and sideboard analysis. The Service is informational and educational. We are an independent publisher and are not affiliated with, endorsed by, or sponsored by Wizards of the Coast LLC or Hasbro, Inc. All Magic: The Gathering names, card names, and related marks are the property of their respective owners.

2. Eligibility

You must be at least 13 years old to create an account, and at least 18 years old (or the age of majority in your jurisdiction) to make a purchase. By using the Service you represent that you meet these requirements and that the information you provide is accurate.

3. Accounts

You may need to create an account to access certain features, including purchased content. You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You agree to notify us promptly at [email protected] of any unauthorized use. We may suspend or terminate accounts that violate these Terms.

4. Purchases and pricing

Pricing. Full Access to a specific guide is sold as a one-time purchase of US $15.00 per guide version, unless otherwise stated at the point of sale. Prices are shown in U.S. dollars and may change at any time, but changes will not affect purchases already completed.

What you receive. A purchase grants you access to the specific version of the guide you bought. We may issue occasional revisions to a version you already own - for example, to correct minor errors - at no additional charge; these corrections are distinct from a new version. A new version of a guide (such as one covering a later metagame period) is released and sold separately. A purchase of one guide version does not entitle you to future versions, additional guides, or other content, unless we state otherwise. Any access to new versions is at our discretion.

Payment processing.Payments are processed by our third-party payment processor, Stripe. By purchasing, you agree to Stripe’s applicable terms. We do not store your full payment card details. You represent that you are authorized to use the payment method you provide.

Delivery. Purchased content is delivered digitally and is typically made available immediately upon successful payment.

5. Refunds

Purchases of digital guide content are final and non-refundable, because content is delivered instantly upon purchase. Please review the free content and the description of each guide before buying. Our complete policy, including how to contact us before disputing a charge, is set out in our Refund Policy, which is incorporated into these Terms.

6. License to use content

Subject to these Terms and your payment of any applicable fees, Deck Guides grants you a limited, personal, non-exclusive, non-transferable, revocable license to access and view the guide content you have lawfully obtained, solely for your own personal, non-commercial use.

You may not:

  • copy, reproduce, republish, distribute, sell, sublicense, rent, or lease any guide content, in whole or in part;
  • share your account or purchased content with others, or post it publicly (including on forums, Discord servers, file-sharing sites, or social media);
  • remove or alter any copyright, attribution, or proprietary notices;
  • use the content to train, fine-tune, or develop any machine-learning or AI model; or
  • use automated means (scrapers, bots) to access, copy, or harvest content from the Site.

All guide content, text, layout, graphics, logos, and the compilation thereof are owned by Deck Guides LLC or its licensors and are protected by copyright and other intellectual property laws. We reserve all rights not expressly granted.

7. Acceptable use

You agree not to misuse the Service, including by: attempting to gain unauthorized access to the Site or other users’ accounts; interfering with or disrupting the Service; circumventing paywalls, access controls, or usage limits; or using the Service for any unlawful purpose.

8. User-submitted content and communications

If you contact us or submit feedback, you grant us the right to use that feedback to operate and improve the Service without obligation to you. Do not submit anything unlawful, infringing, or that you do not have the right to share.

9. Disclaimers

The Service is provided “as is” and “as available.” Strategy content reflects our opinions and analysis at a point in time; Magic: The Gathering is a game of variance and an evolving metagame, and we make no guarantee of any competitive result, win rate, or outcome. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of liability

To the fullest extent permitted by law, Deck Guides LLC and its owner will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the amount you paid us in the twelve (12) months before the event giving rise to the claim, or US $15.00, whichever is greater. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Deck Guides LLC and its owner from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising from your violation of these Terms or your misuse of the Service.

12. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Sections that by their nature should survive termination (including license restrictions, disclaimers, limitation of liability, and indemnification) will survive.

13. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, notify you or require you to re-accept the Terms before continuing to use the Service. Your continued use after changes take effect constitutes acceptance.

14. Governing law and disputes

These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-laws rules. You agree that any dispute will be resolved in the state or federal courts located in Colorado, and you consent to their jurisdiction, except where applicable law provides otherwise.

15. Miscellaneous

These Terms, together with the Privacy Policy and Refund Policy, are the entire agreement between you and Deck Guides regarding the Service. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets.
